The petitioner seeks regular bail in Mashrakh P.S. Case No.61 of 2017 registered for the offence under Sections 147, 148, 149, 341, 109, 323, 324, 337, 307 and 504 of the I.P.C.

Allegation against the petitioner is of cutting throat of the victim by hasuli causing grievous injury. Submission of the learned counsel for the petitioner is that at the place of occurrence father of the petitioner put the son of the informant down to the earth and six persons including the petitioner came there both

Patna High Court Cr.Misc. No.41317 of 2017 (2) dt.07-09-2018 2/2 sides have assaulted to each other and there is injury on the mother of the petitioner also which is incised injury. Further injury report shows that the injury is of about one hour. He is in custody since 12.06.2017.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, and considering that the injury is on the vital part of the body as well as the aforesaid submission at this stage, I am not inclined to grant bail to the petitioner. However, petitioner may renew his prayer for bail after framing of charge in this case.
