The petitioner is in judicial custody in connection with Civil Lines P.S. Case No. 501 of 2021 for the offences under Sections 419 and 420 of the Indian Penal Code and Section 3/10 of the Bihar Conduct of Examination Act. The allegation in the FIR is that the petitioner was appearing in +2 District School, Gaya in place of one Anil Kumar. In course of verification, the photographs on the admit card did not tally with the petitioner and accordingly, he was subject to interrogation and later arrested.

Learned counsel for the petitioner submitted that for the said misdeed, he has already suffered by being in jail since

Be that as it may, the charge sheet has already been submitted and the petitioner is in custody since 27.11.2021 this Court is inclined to grant him the privilege of bail. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate, Gaya in connection with Civil Lines P.S. Case No. 501 of 2021, subject to the following conditions. (i) one of the bailor should be the family member of the petitioner, who shall provide official document to show his/her bona fide;

(ii) the petitioner shall desist from committing any criminal offence again failing which the State shall be at liberty to take steps for cancellation of his bail bonds. With the aforesaid observations, the bail application is allowed.
