JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 147, 148, 149, 341, 323, 325, 307, 504, 506 of the Indian Penal Code.
As per prosecution, the petitioner is said to have assaulted on the head of the father of the informant with iron rod and threw him from the tiles roof along with other accused persons. Thereafter petitioner and co-accused Ganesh Mahto also assaulted the informant on his head with iron rod. It is submitted on behalf of the petitioner that the petitioner has falsely been implicated in the present case due to land dispute. There is a case and counter case between the parties. It has further been submitted that there is no head injury to the
Patna High Court Cr.Misc. No.32566 of 2017 (2) dt.13-07-017 2/2 informant's father. Co-accused Ganesh Mahto has been enlarged on bail by a co-ordiante Bench of this Court vide order dated 01.07.2017 passed in Cr. Misc. No. 27250 of 2017. The petitioner is in custody since 21.03.2017.
Having considered the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief judicial Magistrate-1st, Lakhisarai, in connection with Chanan P.S.Case No. 18 of 2017.
