Petitioner, in the present case, is seeking regular bail in connection with Kochadhaman P.S. Case No. 106/2017 registered for the offence punishable under Sections 394 of the Indian Penal Code.
Learned counsel for the petitioner submits that the F.I.R. is against unknown, however the petitioner has been brought in this case on the basis of confessional statement of the co-accused and allegedly a sum of Rs. 2000/- and a sickle which is normally kept in the household have been recovered from his possession. Learned counsel submits that the petitioner
Patna High Court Cr.Misc. No.4860 of 2018 (2) dt.02-02-2018 has got one case on his head as stated in paragraph 3 of this application, on which he is on bail. In the present case, he is in custody since 08.07.2017, however no T.I. parade has been conducted till date and there is nothing to connect him with the present case. He further submitted that the coaccused in this case has been granted privilege of regular bail by co-ordinate Bench of this Court.
Learned Additional Public Prosecutor for the State opposes the prayer for bail of the petitioner. Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 15,000/- (Rupees fifteen thousand only) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Kishanganj, in connection with Kochadhaman P.S. Case No. 106/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
