====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner seeks regular bail in connection with Alauli P.S. Case No. 255 of 2021 lodged under Sections 147, 148, 149, 341, 323, 307, 326, 308 and 506 of the Indian Penal Code.

As per the allegation made in the F.I.R., the informant disclosed that the petitioner alongwith others entered into the tea shop of the petitioner and started abusing. The specific allegation of gun shot is upon Ajay Chaudhary, Amit Chaudhary and Vivek Choudhary but not upon the present petitioner. He is alleged to be the member of mob.

On the point of criminal antecedent it has been

Patna High Court CR. MISC. No.14577 of 2022(2) dt.06-07-2022 2/2 informed by the learned counsel for the petitioner that in both cases he is on bail. Learned counsel for the petitioner also ready to file an affidavit that in future, he shall not involve in criminal activity.

Learned A.P.P. has opposed the prayer for bail. In the present facts and circumstances of the case and considering that there is no direct allegation against the present petitioner for act or overt act rather he was only member of mob and considering the period of custody that he is in custody since 20.01.2022, let the petitioner above named, be granted bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No. 255 of 2021. Petitioner is also directed to file an undertaking that he shall not involve in such types of activities in future before trial court at the time of furnishing his bail bond.

The prosecution is at liberty to file cancellation of bail, in case the petitioner violates his undertaking. (Dr. Anshuman, J.) ravishankar/- U T
