JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 06-07-2017 Petitioner, who is husband of the complainant, apprehends arrest in a case under section 498A IPC. Allegation is of demand of dowry and torture thereof even after sorting out the difference through a compromise. Petitioner submits that earlier the complainant had filed a case which resulted in compromise. She has also filed a maintenance case. He submits that thereafter she has filed the instant case.

Having regard to the nature of allegation, the prayer for bail of the petitioner is refused with direction to surrender and pray for regular bail, which would be considered on the same day on its own merit without prejudice also taking into consideration that the complainant has filed a maintenance case which is pending.
