====================================================== CORAM: HONOURABLE MR. JUSTICE DR. ANSHUMAN ORAL ORDER 06-07-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner seeks regular bail in connection with N.D.P.S Trial No. 01 of 2022 arising out of Guthani P.S. Case No. 173 of 2021 lodged under Sections 8, 21(a) of the N.D.P.S. Act As per the prosecution case, the present case has been lodged against two named persons and out of two, one was caught raid handed and from whose possession 7g heroine was recovered whereas the name of present petitioner has figured in this case after confessional statement of the arrested accused person.

Learned counsel for the petitioner submits that petitioner is in custody since 04.09.2021 and charge sheet has

Learned counsel for the State opposes the prayer for bail.

Considering the facts and circumstances of this case that there is nothing was recovered from the possession of the petitioner and considering the period of custody since 04.09.2021, but having 5 criminal antecedent all of similar nature and therefore, directed the trial court to consider his bail application only after framing of charge.

The Petitioner is directed to appear on each and every date before the trial court after grant of bail by the trial court. With this direction application disposed of.
