====================================================== CORAM: HONOURABLE MR. JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 15-11-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 406, 420 of the Indian Penal Code.

The petitioner is alleged to have taken cheques under the scheme of Jal Nal Yojana for supply of the materials but the materials have not been supplied. It is submitted by learned counsel for the petitioner that petitioner has falsely been implicated in this case. The petitioner has not received any payment or cheque to anyone. The cheques were issued in favour of co-accused Pradeep Kumar Yadav and since petitioner

Patna High Court CR. MISC. No.14177 of 2022(3) dt.15-11-2022 2/2 is relative of co-accused Pradeep Kumar Yadav, hence, he has been implicated in this case. There is no documentary proof with regard to issuing any cheque in favour of the petitioner. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

In the facts and circumstance of the case, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/-(Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Gaunaha P.S. Case No. 136 of 2020, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
