JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-08-2017 The petitioner is in custody since 04.05.2017 in connection with Ara Town P.S. Case No. 234 of 2017, registered for offences punishable under Sections 341, 342, 354(D) and 509 of the Indian Penal Code.
Allegation against the petitioner is of taking obscene pictures of the daughter of the informant and making it viral on Whats App, resultantly, the marriage of the daughter of the informant has not been solemnized.
It has been submitted on behalf of the petitioner that the petitioner, happens to be the student of Intermediate, is of clean antecedent and has not committed any offence. As a matter of fact, now marriage of victim girl has been solemnized to another one and she is leading her conjugal life happily. Moreover, charge sheet under Section 354(D) of the Indian Penal Code, which appears to be bailable in nature, has been submitted against the petitioner and he has been rotting
Patna High Court Cr.Misc. No.35669 of 2017 (2) dt.08-08-2017 2/2 in custody for more than three months.
Heard learned A.P.P. also.
Having heard both the sides, considering the facts and circumstances of the case, as stated above, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur, Ara, in connection with Ara Town P.S. Case No. 234 of 2017, with following conditions:- (i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
(ii) The petitioner will not induce any witness or tamper with the evidence.
(iii) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court and on the event of failure on his part to appear before the court below on two consecutive dates without showing any genuine reasons, the prosecution will be free to move for cancellation of his bail bonds.
