Petitioner, already in custody, seeks bail in connection with Naya Ram Nagar P.S. Case No.128 of 2004, registered under Sections 147, 148, 149, 323, 324, 337, 332, 333, 353, 307, 504 and 506 of the Indian Penal Code as well as under Section 27 of the Arms Act.

Allegation in brief is that police team went to apprehended the petitioner, as per the allegation a notorious criminal of the area, but there was serious resistance and firing was also opened from his house so that he could escape and could not be arrested and several persons were apprehended from the house of the petitioner with arms.

Having considered the fact that it is a case of the year 2004 and petitioner remained absconder for a decade and the petitioner has chequered criminal history, involved in so many serious offences, so prayer of bail of the petitioner is rejected in connection with Naya Ram Nagar P.S. Case No.128 of 2004, giving rise to S.T. No.663(B) of 2013, pending in the court of learned Additional Sessions Judge-Ist, Munger. However, the trial court is directed to expedite the trial.
