Petitioner, already in custody, seeks bail in connection with Chausa P.S. Case No.312 of 2017, registered under Sections 353 and 307 of the Indian Penal Code as well as under Sections 25(1b)a, 26, 27 and 35 of the Arms Act. Allegation in brief is that petitioner and his father both were apprehended by the police and from possession of the petitioner two country made pistols, nine live cartridges of .315 bore, one live cartridge of .762 bore and three empty cartridges were recovered whereas three fire arms, 17 live cartridges of .315 bore and one empty cartridge were recovered from possession of father of the petitioner.

Learned counsel for the petitioner submits that the petitioner

Patna High Court Cr.Misc. No.17030 of 2018(2) dt.27-03-2018 2/2 has falsely been implicated in this case and he is in custody since 03.11.2017.

Having considered the recovery of number of fire arms and cartridges as also one criminal antecedent of the petitioner, the prayer of bail of the petitioner is rejected. The trial court is directed to expedite the trial and preferably conclude the same within a period of nine months from the date of framing of the charge.
