JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court in Cr.Misc. No. 24960 of 2017, vide order dated 10.7.2017 with direction to learned trial court to conclude trial within a period of five months and if not concluded the petitioner was given liberty to renew his prayer for bail in the court below. Submission of learned counsel for the petitioner is that trial has not been concluded and petitioner is in custody since 23.11.2016 and there is no recovery from the possession of the petitioner.

Having heard both sides and in the facts and circumstances, this application is disposed of with a direction to learned trial court to find out as to whether there is any recovery
Patna High Court Cr.Misc. No.6027 of 2018 (2) dt.08-02-2018 2/2 from the possession of petitioner at the time of seizure and if there is no such recovery, learned trial court shall release the petitioner on bail to its own satisfaction.
