Petitioner seeks bail in a case registered for the offences punishable under Sections 304B, 201, 120B/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act. The petitioner is husband of the victim of dowry death.
Submission is that since the marriage was intercaste there was no question of demand or payment of any dowry. The case diary would reveal that due to some quarrel in the family, the victim committed suicide. Petitioner is in custody since 15.03.2017.
Considering the period already undergone as well as the completion of investigation and the submission aforesaid,
Patna High Court Cr.Misc. No.10403 of 2018 (3) dt.04-04-2018 2/2 let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bikram Police Station Case No. 62 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
