Heard learned counsel for the petitioner and learned A.P.P. for the State.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 5, 8 and 25 of the Bihar Kast Chiran Act, 1990 and Sections 41, 42 and 52 of the Indian Forest Act, 1989.

Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and has been falsely implicated in the instant case by the complainant based on suspicion that petitioner was running a sawmill in absence of license. It is next submitted that the sawmill does not belong to the petitioner. It is further submitted that since the petitioner has a furniture shop as such it was suspected that petitioner might

Patna High Court CR. MISC. No.17411 of 2024(2) dt.21-03-2024 2/2 have been involved in running the sawmill. It is further submitted that petitioner will not abscond rather will cooperate in the trial.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Official Complaint Case No. 78 of 2023, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.

However, it is made clear that the learned trial court will be at liberty to cancel the bail bonds of the petitioner, if it comes to a conclusion that the petitioner after obtaining bail is trying to delay the trial in any manner.
