The petitioner seeks pre-arrest bail in connection with G.O. Case No. 378 of 2014 registered under Sections 47(a) of the Essential Commodities Act.
It is contended by the learned counsel for the petitioner that the alleged recovery of illicit liquor was made from a house which was occupied by several persons including the petitioner and, hence, it cannot be said that it was the petitioner who was illegally possessing the illicit liquor. Be that as it may, regard being had to the recovery
Patna High Court Cr.Misc. No.13823 of 2016 (2) dt.01-04-2016 2 / 2 made from the house of the petitioner, I am not inclined to grant him anticipatory bail. Accordingly, the application for anticipatory bail is rejected.
In case the petitioner surrenders and seeks bail, the same shall be considered on its own merit without being prejudiced in any manner by this order.
