2. The petitioner seeks regular bail in a case registered for the offence under Section 392 of the Indian Penal Code.

3. As per the prosecution case, the accused persons are said to have looted Rs. 1,00,000/- from the victim. Rs 45,000/- has been recovered from the co-accused.

4. Learned counsel for the petitioner without accepting the guilt of the petitioner has submitted that petitioner is ready to make good the loss sustained by the victim and is ready to pay Rs. 50,000/- to the victim. Petitioner is in custody since 13.09.2023. He further submits that co-accused Mahadev

Patna High Court CR. MISC. No.19191 of 2024(2) dt.02-04-2024 2/2 Kumar has been granted bail by a co-ordinate Bench of this court in Cr. Misc. No. 18158 of 2024 dated 14.03.2024.

5. Learned A.P.P. has vehemently opposed the prayer for bail.

6. Considering the period of custody and the fact that co-accused has been granted bail, this application for regular bail is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned J.M.F.C., Saharsa/concerned Court below in connection with Sonbarsa Raj P.S. Case No. 189 of 2023.

8. It is made clear that the amount of Rs. 50,000/- shall be deposited in the court below at the time of furnishing bail bonds and if such an amount is deposited by the petitioner, the same shall be released in favour of the victim by the Court below. If such an amount is not deposited, the bail bond of the petitioner shall not be accepted.

9. This application stands allowed.
