1. Heard learned counsel for the petitioners and learned APP for the State.

2. The petitioners seek bail in anticipation of their arrest in a case registered for the offences punishable under Sections 409, 420 and 34 of the Indian Penal Code.

The learned counsel for the petitioners submits that the petitioners are persons with clean antecedent and are women and the informant, Panchayat Secretary, alleges that petitioners are Ward Member and Ward Secretary of Ward No.5 of Jaanta Panchayat and an amount of Rs.17,82,420/- was deposited in the account of the Managing Committee for executing the work of 07th Nischai Yojna. 4. The learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case based on surmises and conjectures. It is next submitted that the amount of Rs.17,82,420/- was credited in the account of the Managing Committee and from the said account and an amount Rs.17,02,832/- was withdrawn for the purposes of completing the work under Saat Nischai Yojna. It is also submitted that there was no government land in Ward No.5, as such, the petitioner no.2 offered her land, on which water tower and tank were constructed. It is also submitted that from perusal of Annexure-2 to the writ application, it would manifest that the Measurement Book with regard to the work recorded worth Rs.17,02,832/-. It is next submitted that rest of the amount is lying in the account of the Managing Committee. It is also submitted that petitioners will not abscond rather will cooperate in the investigation.

5. Learned A.P.P. opposes the anticipatory bail application.

6. Considering the submissions made by the learned counsel for the petitioners, the petitioners, above-named, in the

No.19166 of 2025(2) dt.23-04-2025 3/3 event of their arrest or surrender before the learned Court below within a period of six weeks, are directed to be released on bail on their furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of Court No.2 of JMFC, Muzaffarpur (East) in connection with Gaighat P. S. Case No.392 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
