====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 09-05-2025 Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 8(B), 8(C), 18, 29, 46 of the Narcotic Drugs and Psychotropic Substances Act.

3. This petitioner is alleged to be involved in cultivation of opium and 20 opium plants were recovered from possession of the accused persons including petitioner.

4. Learned counsel for the petitioner submits that no incriminating material has been recovered from conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner has been made accused only on suspicion. Petitioner claims clean antecedent.

5. Learned A.P.P. for the State vehemently opposes the

Patna High Court CR. MISC. No.13670 of 2025(4) dt.09-05-2025 2/2 bail application and submits that petitioner is owner of the field in which opium was being cultivated.

6. Considering the fact that petitioner is owner of the field where the seized opium was being cultivated, prayer for anticipatory bail of the petitioner is refused. (Prabhat Kumar Singh, J) Navya/- U T
