JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 20-07-2017 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.

There was dispute amongst mother of informant with Bablu Kumar Singh as, Bablu Kumar Singh was not returning Rs.500/- which he had borrowed from his mother, had gone to his house giving threatening. Subsequently, at about 7.00 p.m., he along with others including the petitioner came, out of whom, Bablu Kumar Singh caught hold informant, Binod Kumar Singh threw him on ground and began to assault. At the other end, Arjun Singh (petitioner), Pankaj Kumar Singh, Raja Singh, Anil Singh caught hold his younger brother Pramod Kumar Singh and Birendra Singh, Sushil Singh and Mukesh Singh gave repeated Chhura blow. Ajay Kumar Singh, Ranjay Singh, Kameshwar Singh began to assault his elder brother Ram Babu Singh. Seeing

Patna High Court Cr.Misc. No.33878 of 2017 (02) dt.20-07-2017 the villagers, all the accused persons fled away. In course of carrying Pramod Kumar Singh to hospital, he succumbed. Considering the nature of allegation, as stated above, petitioner, Arjun Singh is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate-1st, Samastipur in connection with Tajpur P. S. Case no.06 of 2017.
