ANJANA MISHRA ORAL ORDER 01-02-2018 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 30.10.2017 in connection with Banmankhi P.S. Case No.221 of 2017 registered for the offence under Sections 457 and 380 of the Indian Penal Code.
Learned counsel appearing on behalf of the petitioner submits that the present case has been lodged on account of dispute with regard to the landed property and at the instigation of villagers who are inimical to the petitioner. It is further submitted that though the occurrence is alleged to have been committed on 7th of September, 2017, yet the F.I.R. was registered on 14th of September, 2017 and for the said delay, no
Patna High Court Cr.Misc. No.5562 of 2018 (2) dt.01-02-2018 2/2 plausible explanation has been offered. It is further submitted that the petitioner has no criminal antecedent and has been languishing in jail for no fault of his.
Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Chief Judicial Magistrate, Purnea, in connection with Banmankhi P.S.
