2. The petitioner apprehends his arrest in connection with Sugauli P.S. Case No. 371 of 2023, registered for the offences punishable under Sections 363, 366(A) of the I.P.C. and section 4 of the POCSO Act.
3. As per allegation, the petitioner along with other co-accused is said to have kidnapped the daughter of the informant(victim). On search informant found that ornaments worth Rs. 80,000/- and Rs. 1 lac was also missing from the almirah of the house.
4. Learned counsel for the petitioner has submitted that the informant left her house along with the petitioner on her
Patna High Court CR. MISC. No.16944 of 2024(2) dt.14-03-2024 2/2 own sweet will, this fact find place in the statement of victim recorded under Section 164 of the Cr.P.C. Learned counsel further submits that the petitioner is a person of clean antecedent.
5.Considering the above-mentioned facts and circumstances, let the petitioner, in the event of his arrest or surrender within four weeks before the learned court below, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 6th Additional Sessions Judgecum-Special Judge, POCSO Act, East Champaran, Motihari in connection with Sugauli P.S. Case No. 371 of 2023, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Nawneet Kumar Pandey, J) Sudha/- U T
