JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 2 11-09-2015 Heard learned counsel for the petitioners and learned counsel for the State.

The petitioners seek pre-arrest bail in connection with Vaishali P.S. Case No. 390 of 2014 registered for the offences punishable under Sections 406, 420, 467 and 468 of the Indian Penal Code.

It is contended that there is no truth behind the allegation made in the FIR. As a matter of fact, the informant has asked the petitioner no. 1 to arrange for the employment and after meeting with the authority of the institution on 06.06.2012 and 18.06.2013 respectively the said institution

After teaching for 3-4 months the petitioners and other did not get their salary. On query, the petitioner no. 1 learnt that the institution which has issued appointment letter is forged and fictitious institution and accordingly, the petitioner no. 1 wrote a letter to the Superintendent of Police, Vaishali and also filed an informatory petition vide informatory petition No. 65 of 2014 before the court of Chief Judicial Magistrate, Vaishali. Learned counsel for the State has opposed the prayer for anticipatory bail. He has submitted that according to the prosecution case, the petitioners who are husband and wife came to the informant and stated that petitioner no.

1 has got employment as a teacher in the Sanskriti Bal Shiksha Pariyojana and he would be getting Rs. 4,000/- per month as salary. The petitioner no. 1 has also stated that he has got employment by spending money and if the informant's son and his brother want employment they have to spent Rs. 60,000/-.
