JUSTICE SANJAY PRIYA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Saharsa P.S. Case No. 1006 of 2016 instituted for the offence under Section-409 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that he is ready to complete the building within a period of three months from the date of release.
The report was called for, from the Headmaster which has been received. It has been mentioned in the report that there were two newly constructed buildings, one of the building is one storied and its construction work is nearly complete. The ceiling is complete but floor work is almost incomplete. The doors and windows are yet to be fixed. Painting is also due. The construction work of other two storied building is also complete. The floor and stair is also almost complete. In this manner, from the report of headmaster, it appears
Patna High Court Cr.Misc. No.31300 of 2017 (3) dt.01-08-2017 that major portion of the construction work has already been completed. The petitioner undertakes that he will complete the remaining work within three months from the date of his release. In such circumstances, prayer for bail is allowed. The petitioner named above is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Saharsa P.S. Case No. 1006 of 2016 to the satisfaction of learned Chief Judicial Magistrate, Saharsa subject to condition that both the bailors should be close relative of the petitioner. The petitioner will complete the remaining construction work of school building within three months from the date of his release.
It will be open to the informant to file petition for cancellation of bail before the court below itself, in the event, he does not finish the work in three months. The headmaster and the authority concerned will allow the petitioner to compete the work within the period as directed by this court which shall be disposed off in accordance with law.
