ANJANA MISHRA ORAL ORDER 24-06-2016 Heard learned counsel for the petitioners and learned counsel appearing on behalf of the State.

The petitioner being the husband is apprehending his arrest in connection with Complaint Case No. 656 of 2013 for the offences registered under Sections 498A of the Indian Penal Code.

Learned counsel for the petitioner submits that though the petitioner is ready to keep the opposite party no. 2 with full honour and dignity and on several occasions he is tried to bring her back along with her three children, yet the opposite party no. 2 has not cooperated and is contesting the matter for reasons based known to her.

No.19668 of 2015 (8) dt.24-06-2016 In view of the aforementioned submissions and that despite service of notice, she has failed to appear before this court, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Kaimur at Bhabua in connection with Complaint Case No. 656 of 2013, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
