JUSTICE DINESH KUMAR SINGH ORAL ORDER 22-06-2016 The present application has been filed for modification of the order dated 24.02.2016 passed in Cr. Misc. No. 8819 of 2016 to the extent that petitioner of the present modification application being wife of petitioner of Cr. Misc. No. 8819 of 2016 is ready to reside with her husband, though it was recorded in the order dated 24.02.2016 that reconciliation is not feasible since earlier Pupri P.S. Case No. 182 of 2013 was filed by the petitioner levelling accusation under Sections 363, 365 of the Indian Penal Code against other family members of her husband Mukesh Kumar.

Considering the inconsistent stand of the petitioner, this Court is not inclined to modify the order. However, the petitioner is at liberty to raise all the contentions at the appropriate proceeding.

Patna High Court Cr.Misc. No.12786 of 2016 (3) dt.22-06-2016 2/2 Accordingly the modification application is disposed of in connection with Sitamarhi P.S. Case No. 384 of 2012, pending in the Court of learned S.D.J.M, Sadar, Sitamarhi.
