Misc. applications have cropped up from the same P.S. case, hence they are taken up together for consideration and disposed of by this common order. Heard learned counsel for the petitioners and learned APP for the State.

The petitioners seek bail in connection with Mokama P.S. Case no. 28 of 2018 registered under Section 30(a) of Bihar

Patna High Court Cr.Misc. No.21692 of 2018(2) dt.17-04-2018 2/2 Prohibition & Excise Act-2016.

63 lts. of foreign liquor is said to have been recovered from the house of Ghos Singh and petitioners and one other accused person were apprehended while three accused persons managed to escape.

It is submitted by learned counsel for the petitioners that no incriminating article has been recovered from conscious physical possession of the petitioners. They have no concern either with the seized liquor or with the place of recovery. They have been falsely implicated in the case at the instance of their enemies by apprehending from their own house. They have no criminal antecedent. They have been languishing in custody since 10.02.2018.

In the facts and circumstances of the case, the above named petitioners are directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise Act, Patna in connection with Mokama P.S. Case no. 28 of 2018.
