The petitioner seeks bail in anticipation of his arrest in connection with Ghorasahan P.S. Case No. 358 of 2017 dated 14.07.2017 instituted for the offences under Sections 272 and 273 of the Indian Penal Code and under Sections 30(a), 36 of the Bihar Excise (Prohibition) Act, 2016.
73 litres of liquor is said to have been recovered from the possession of two persons who were riding a motorcycle and who were intercepted by the police.
The aforesaid two arrested persons have named the petitioner and hence the prosecution of the petitioner in the instant case. There is no recovery from
Patna High Court CR. MISC. No.15584 of 2019(2) dt.15-03-2019 2/2 the possession/constructive possession of the petitioner and he has clean antecedent.
Taking into account the aforesaid facts, the petitioner is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned learned Special Judge, Motihari, East Champaran in connection with Ghorasahan P.S. Case No. 358 of 2017, subject to the conditions as laid down under Section 438(2) Cr.P.C.
