JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 16-09-2021 Heard learned counsel for the petitioner and learned APP for the State through virtual Court proceedings. The petitioner seeks bail in a case registered for the offence punishable under Section 414 of the Indian Penal Code and Section 25(1-b)a/26 of the Arms Act.

Allegation against the petitioner is that the police had recovered one country made pistol, two live cartridges of 315 bore, one live cartridge of 12 bore and one submersible pump from the house of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He further submits that in absent, the police had recovered one country made pistol, three live cartridges and one submersible pump from the house of the petitioner. The

Patna High Court CR. MISC. No.24259 of 2021(2) dt.16-09-2021 2/2 petitioner is languishing in judicial custody since 16.01.2021. The petitioner has got one criminal antecedent which is mentioned in para 3 of the bail petition.

Learned APP for the State vehemently opposed the prayer for bail application.

Considering the custody of the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each in connection with Murar P.S. Case No. 87/2020 to the satisfaction of learned Court below where the case is pending/ successor Court.
