JUSTICE NAVANITI PRASAD SINGH ORAL ORDER 11-06-2015 The petitioners, who are father-in-law and mother-in-law of the victim girl, who happens to be their daughter-in-law, apprehend their arrest in relation to Kutumba P.S. Case No. 101/2014 instituted for the offences under Sections 304(B)/34 of the Indian Penal Code.
It is alleged that the son of the petitioner and Kabita Devi, the deceased, was married in the year 2011 and she was tortured for demand of dowry etc. In the First Information Report, it is further alleged that on 10.06.2014, the informant's daughter had been poisoned to death.
Learned counsel for the petitioners draws attention of this Court to the fact that for the first time the
Patna High Court Cr.Misc. No.18279 of 2015 (2) dt.11-06-2015 complaint was made by the informant to the Superintendent of Police on 09.10.2014 i.e. four months after the incident and the F.I.R. has been instituted on 03.12.2014. He further draws attention of this Court to the fact that the husband of the deceased has already been granted bail by this Court in Cr. Misc. No. 11366/2015 by order dated 23.03.2015 noticing that the lady had died in course of treatment.
Be that as it may, in the event of their arrest/surrender before the court below within four weeks, let the petitioners, namely, Ramdeo Ram @ Ramde Ram and Surajmani Devi @ Suiraj Mani Devi, be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Kutumba P.S. Case No. 101 of 2014, subject to conditions laid down under Section 438 (2) of the Code of Criminal Procedure.
