The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 420 of the Indian Penal Code and Section 138 of the N.I. Act. The son of the petitioner had issued cheque in favour of the complainant which bounced. The cheque was issued to repay the outstanding dues, which the complainant had advanced for business purpose.

Submission is that, in fact, the complainant is brotherin-law of the petitioner and sister of the petitioner had brought

Patna High Court CR. MISC. No.21500 of 2019(2) dt.05-04-2019 2/2 Maintenance Case No.47M of 2012 against her husband, who is informant of this case, and for that cause false case has been lodged after committing theft of cheque.

Considering the entire facts aforesaid, let the petitioner, above named, in the event of his arrest or surrender before the Court below within a period of thirty days from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Patna, in connection with Complaint Case No.3594C of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure as well as condition that the petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
