2. The petitioner apprehends his arrest in a case registered for the offence under Sections 316(2), 318(4), 3(5) of the Bhartiya Nyaya Sanhita, 2023.
3. As per the prosecution case, informant gave Rs. 3,50,000/- to this petitioner for purchasing a piece of land measure 8 katha and later on, it was found that paper of land was fake and as such, registry of said land was cancelled and thereafter, despite repeated request by informant to return his money, the petitioner did not return the said amount.
4. Learned counsel for the petitioner submits that petitioner is innocent and has committed no offence. By way of filing supplementary affidavit, learned counsel for the petitioner
Patna High Court CR. MISC. No.14974 of 2025(5) dt.30-07-2025 2/3 submits that petitioner executed a sale-deed, vide Survey Khata No. 189, Survey Kheshra No. 989 Area 25 decimal land on a consideration amount of Rs. 1,40,000/- in favour of wife of informant, out of which, petitioner has already returned Rs. 1,25,000/- to the informant (payment receipt is at Annexure 1 to the supplementary affidavit) and he (petitioner) is ready to return rest amount of Rs. 15,000/- by way of demand draft (copy of demand draft is at Annexure 2 to the supplementary affidavit) in the Nazarat of Civil Court, Bhojpur (Ara).
5. Learned A.P.P. for the State opposes the bail petition.

Considering the aforesaid facts and circumstances, let the above named petitioner, in the event of arrest/surrender within a period of eight weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhojpur at Ara in connection with Udwant Nagar P.S. Case No. 446 of 2024, subject to condition as laid down under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023 with further condition that at the time of furnishing bailbond, petitioner shall deposit the demand draft of Rs. 15,000/- in the Nazarat of concerned Civil Court, which will be subject
