JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner and learned Assistant Public Prosecutor for the State. This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 324, 307/34 of the Indian Penal Code and Section 27 of the Arms Act.
Learned counsel appearing on behalf of the petitioner submits that there is no allegation of any overt act against the petitioner, though such allegation is there against one Pankaj Yadav. He has further submitted that in similar circumstance, other co-accused persons, namely, Santosh Yadav and Ravi Yadav, have been granted the privilege of anticipatory bail by this Court vide order dated 20.03.2015, passed in Cr. Misc. No.
Patna High Court Cr.Misc. No.19267 of 2015 (3) dt.25-06-2015 2/2 11192 of 2015.
In view of the submission as above, let the petitioner, abovenamed, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Khagaria in connection with Gogari P.S. Case No. 233 of 2014 (G.R. No. 2295/2014), subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
