The petitioner seeks pre-arrest bail in connection with Case No. C-7-08 of 2014, registered under Sections 47(A) and 47(F) of the Bihar Excise Act.

The accusation is of recovery of 1000 Kg Jawa Mahua, some apparatus for preparing the liquor and 55 liters country made liquor in two containers nearby the house of the petitioner.

Submission is that it would appear from the seizure list that the alleged Jawa Mahua, apparatus, meant for preparing liquor in two containers, were not recovered from the house of the petitioner rather the same had been recovered near

Patna High Court CR. MISC. No.12890 of 2020(2) dt.03-07-2020 2/2 the house of the petitioner. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the petitioner, above named, in the event of surrender/arrest, within a period of four weeks from today, in connection with Case No. C-7-08 of 2014 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge II-cum-Special Judge, Banka, or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
