The petitioner seeks bail in a case registered under Sections 147, 148, 149, 307, 323, 337, 338, 341, 353, 427, 435, 436, 504, 506, 120(B) of the Indian Penal Code and Sections 145, 146, 147, 150, 151, 153, 154, 174 of the Railway Act. The prosecution case, in short, is that the accused persons including the petitioner and 1500-2000 unknown youth attacked on the police force with lathi, danda, rod and they set fire on the engine and bogie of the train. Many police force sustained injuries.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 18.06.2022. Charge sheet/prosecution report has been submitted in this case. There

Patna High Court CR. MISC. No.15315 of 2023(2) dt.01-05-2023 2/2 is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no chance of trial being concluded in near future. General and omnibus allegation has been made. The petitioner is said to be one of the members for protesting in the mob. No specific allegation has been made against the petitioner.

On behalf of the State, it is submitted that the petitioner is named in the complaint case/F.I.R. Considering the facts and circumstances of the case, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Court below/concerned Court in connection with Danapur (Rail) P.S. case No.100/2022.
