The petitioners apprehend their arrest in a case
Patna High Court CR. MISC. No.24972 of 2021(3) dt.17-01-2022 2/3 registered for the offences punishable under Sections 147, 148, 149, 332, 333, 323,325, 504, 307, 267, 356, 268, 269, 270, 271 & 188 of the Indian Penal Code.
The allegation against the petitioners is that they along with several co-accused persons variously armed are said to have ransacked the house of Thug Mian. Petitioners are said to be only the members of the mob.
It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case due to dirty village politics. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. Although the petitioners are alleged to be members of the unlawful assembly but no specific over act has been attributed against them. Petitioners have no criminal antecedent.
Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in
