ANJANA MISHRA ORAL ORDER 03-05-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Rajepur PS case no. 164/2015 for allegedly having committed the offence under Sections 363/366A/34 of the Indian Penal Code.

Case diary in the present case was called for which has since been received.

Learned counsel for the petitioner submits that at the time of kidnapping, the petitioner along with Rajiv Kumar was there. There is no other material to support his implication in the present case.

No.13292 of 2016 (3) dt.03-05-2016 2/2 Learned counsel appearing on behalf of the State, after perusal of the case diary, submits that the victim girl aged about 16 yrs. has clearly taken the name of the petitioner as being one of the persons who had forcibly taken away her in Bolero vehicle along with one Rajiv.

Considering the aforesaid facts and circumstances and that the petitioner had a clear role to play in the kidnapping which has subsequently led to a crime under Section 376 IPC, I am not inclined to enlarge the abovenamed petitioner on anticipatory bail.

Accordingly, the anticipatory bail application is rejected.
