Petitioner, already in custody, seeks bail in connection with Dumaria P.S. Case No.28 of 2017, registered under Sections 147, 148, 149, 302, 435 and 379 of the Indian Penal Code.

Allegation in brief is that due to land dispute, quarrel took place and Satendra Prasad snatched rifle of the husband of the informant and opened fire but did not hit thereafter all accused persons standing there assaulted the husband of the informant with iron rod and garasa as a result he died. Learned counsel for the petitioner submits that there is general and omnibus allegation against the petitioner, evidence shows that specific overt act of assault is against Satendra

Patna High Court Cr.Misc. No.10975 of 2018(3) dt.06-04-2018 2/2 Prasad, Subodh Kumar, Shailesh Kumar and Mithlesh Prasad and this petitioner has no criminal antecedent. Having considered the aforesaid facts and circumstances, petitioner Sujeet Kumar is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned SDJM, Sherghati at Gaya in connection with Dumaria P.S. Case No.28 of 2017.
