Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner has approached this court for regularization of his services as Non-formal Education Instructor.

After some arguments, learned counsel for the petitioner does not dispute the fact that the petitioner did not approached this court prior to the cutoff date with respect to the relief, by virtue of him having discharged duties as Instructor under the Non-Formal Education Scheme.

The said fact not being in dispute, having regard to the decision of the Hon'ble Apex Court in the case of The State

Patna High Court CWJC No.3986 of 2023(2) dt.22-08-2023 2/2 of Bihar and Ors. versus Prabhat Ranjan passed in Special Leave to Appeal (C) No. 32079 of 2015 dated 26.02.2016, and the recent decision of this court in the case of The State of Bihar and Ors. versus Harendra Mishra and Ors. passed in Civil Review No. 59 of 2018 following the order of the Hon'ble Apex Court, the petitioner's claim for regularization or absorption is not tenable.

Writ application is dismissed.
