Having regard to the facts that the petitioner has not filed his objections to the notice under Section 13(2) of the Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act issued by the Bank, this Court is of the opinion that the ends of justice would be served if the petitioner is directed to file his objections to the notice issued by the Bank under Section 13(2) of the Act.
3. The present Writ Petition is disposed of directing the petitioner to file his objections to the notice under Section 13(2) of the Act within a period of four weeks from today. On such objection being filed, the same shall be considered on
Patna High Court CWJC No.4504 of 2024(6) dt.02-12-2024 2/2 merits and necessary orders passed. In case the petitioner is so advised, he is free to approach the Bank authorities for one time settlement of the loan amount or for payment of the loan amount in installments and the Bank shall consider the same on its own merits.
4. With the above direction the Writ Petition stands disposed of.
