====================================================== CORAM: HONOURABLE MR. JUSTICE GOPAL PRASAD ORAL ORDER 19-08-2015 This is a petition for modification of the order dated 22.01.2013 passed in Cr. Misc. No. 44718 of 2011 by which the petitioner was granted bail but on condition that one of the bailors shall be the close relative of the petitioner who will file affidavit to the effect that except one case for the offence under Sections 25 and 26 of the Arms Act he has no criminal antecedent and the trial court on due verification shall confirm the bail bond of the petitioner.
However, on verification, the trial Court found that altogether six cases are pending against the petitioner including the present one.
Hence, having regard to the aforesaid fact the petitioner be released on bail, subject to the condition substituted by the further condition that the petitioner shall file Hazri in the nearest police station once in a fortnight for one year and shall

No.19197 of 2015 (2) dt.19-08-2015 not involve in such type of criminal activity in future and if any report is received regarding his involvement then the court below shall proceed for cancellation of bail bond of the petitioner. Hence, the order dated 22.01.2013 passed in Cr. Misc. No. 44718 of 2011 is modified to the extent indicated above. Let this order be communicated to the Court of learned Chief Judicial Magistrate, Motihari (East Champaran) in connection with Motihari Town P.S. Case No. 18 of 2010 through FAX at the cost of the petitioner.
