JUSTICE PRAKASH CHANDRA JAISWAL ORAL ORDER 06-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in a case registered under Sections 17, 18 of N.D.P.S.Act, 1985.

As per prosecution, petitioner Arun Kumar Chaudhary had given land on Batai to one Jahru Bind and on raid conducted by the police it was found that the said Jahru Bind was cultivating opium on the said land.

It is submitted by the learned counsel for the petitioner that the petitioner happens to be the owner of the said land. He has no concern with the opium rather he had given the said land on Batai to Jahru Bind. It is further submitted that co-accused Narendra Choudhary has been granted bail by a co-ordiante bench of this Court vide order dated 15.06.2017 in Cr. Misc. No. 18503 of 2017. The petitioner is in custody since 17.02.2017.

No.31054 of 2017 (2) dt.06-07-2017 2/2 Considering the facts and circumstances of the case, let, above named petitioner, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Khagaria in connection with Special Case no. 02 of 2016 arising out of Alauli P.S.Case No. 62 of 2016.
