The petitioner has prayed for regular bail in a case registered for the offence punishable under section 395 of the Indian Penal Code.

As per prosecution case, informant alleged that on 24.06.2022, some miscreants entered the Bank and on pistol point looted total cash of Rs. eleven Lakh forty nine thousand (Rs. 11,49,000/-) and fled away.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case merely on the basis of confessional statement of co-accused. Neither petitioner is

Patna High Court CR. MISC. No.20604 of 2023(3) dt.10-08-2023 2/2 named in the FIR nor he has been put on TIP till now. Similarly situated co-accuse has already been granted bail by this Court vide order dated 24.04.2023 passed in Cr. Misc. No. 12292 of 2023. It is further submitted that the petitioner is languishing in judicial custody since 24.08.2022.

Learned APP appearing for the state has opposed the prayer of regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as judicial custody, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Karpi (Telpa) P.S. Case No. 141 of 2022 on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J.-II, Jehanabad.
