The State of Bihar .... .... Opposite Party/s ====================================================== CORAM: HONOURABLE MR. JUSTICE MIHIR KUMAR JHA ORAL ORDER 11-02-2015 Heard learned counsel for the parties.

Having regard to the nature of allegation against the petitioner for the offences punishable under Sections-406/409/420/467/468/471/34 of the Indian Penal Code and the fact that co-accused Rakesh Kumar and Manoj Kumar having identical allegation were already granted anticipatory bail, there was no difficulty for this Court to grant the same privilege to the petitioner, who is also a Junior Engineer. The only reason for which this Court would however refuse to grant anticipatory bail to the petitioner is that though the petitioner was a named accused in police case lodged in the year 2010, his prayer for anticipatory bail now comes in the year

Patna High Court Cr.Misc. No.35440 of 2014 (2) dt.11-02-2015 2015 and the fact that the petitioner remained absconding for a period of over four years.

That being so, the prayer for anticipatory bail of the petitioner is hereby rejected.

Nothing said in this order, however, will come in the way of the petitioner in surrendering before the Court below and praying for regular bail.
