JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 05-12-2023 Heard Mr. Sanjay Kumar, learned counsel appearing on behalf of the petitioner; Mr. Narendra Kumar Singh, learned AC to GP-22 for the State and Mr. Bindhyachal Rai, learned counsel for the Bank.

2. The petitioner has filed the writ petition for the following reliefs:

"That this is an application for issuance of a writ in the nature of Certiorari or any other appropriate writ/order or Direction for quashing the order dated 04.02.2022 pronounced as order on 21.01.2023 issued by the Public Grievance Redressal Officer, East Champaran at Motihari whereby a direction was given to the District Co-operative Officer and the Managing Director of the Motihari Central

Patna High Court CWJC No.4121 of 2023 dt.05-12-2023 2/3 Bank Ltd. to calculate the amount of crop Insurance within 15 days and then to institute a certificate case against the Chairman of the PACs and further the petitioner prays for issuance of writ in the nature of Mandamus commanding and directing the respondent authorities not to give effect of the aforesaid impugned order and/or for issuance of such other order or direction to which the petitioner may be found legally entitled to in the facts and circumstances of the case as stated herein under.

The District Magistrate, East Champaran at Motihari is directed to call for the records relating to the Rampur Khajuria PACs with respect to details of all the farmers who were covered by Crop Insurance and whose crops have been destroyed due to natural calamity and pass a reasoned order after giving proper notice to the Public Grievance Redressal Officer, East Champaran at Motihari, whose action has been questioned in the present writ petition.

In case, the Circle Officer, Kesariya is not able to produce the names of all the farmers uploaded on the website of the State Government as required and is also not able to produce before him all the farmers who have opted for the insurance in accordance with the Government circular and direction of the Central Government giving details of their registration either for Kharif crops or Rabi crops. Appropriate action be taken against the concerned Circle Officer.

5. The Chairman of the PACs, is also required to be heard by the District Magistrate. The District Magistrate,

Patna High Court CWJC No.4121 of 2023 dt.05-12-2023 3/3 thereafter, direct the concerned authorities having jurisdiction to take appropriate action including the Insurance Company concerned.

6. The writ petition stands disposed of.
