Mr.Braj Kishore Pd.(App) ====================================================== CORAM: HONOURABLE MR. JUSTICE SHIVAJI PANDEY ORAL ORDER 13-05-2020 Perused the record and heard learned counsel for the State through video conferencing in view of the total lock-down on account of COVID-19 pandemic.

In this case, the petitioner is seeking regular bail in connection with Special Case No.11024 of 2019 (arising out of Bypass P.S. Case No. 324 of 2019), registered for offence punishable under sections 414/34 of the Indian Penal Code and under section 30(a)/37 (b) (c) of the Bihar Prohibition and Excise (Amendment) Act.

Allegation has been made that about 28 litres of country made liquor has been recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that the

Considering the period of custody, the petitioner, named above, is directed to be released on bail on his personal bond to the satisfaction of Special Judge, Excise, Patna in connection with Special Case No.11024 of 2019 (arising out of Bypass P.S. Case No. 324 of 2019), subject to the condition that if the petitioner is found involved in similar type of case in future, the prosecution will be at liberty to file an application for cancellation of his bail bond.
