The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 363 and 366(A)/34 of the Indian Penal Code and Section 8 of the POCSO Act.

It is a case of abduction of the daughter of the informant by the accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that from perusal of the impugned order, it appears that the victim stated in her statement recorded under Section 161 of the Cr.P.C. as well as under Section 164 of the

Patna High Court CR. MISC. No.14150 of 2022(2) dt.05-09-2022 2/2 Cr.P.C. wherein she stated that she was in love with the petitioner and she solemnized marriage with him at Samastipur. He further submits that her age assessed by the doctor 16 to 17 years who is at the verge of maturity. Petitioner has clean antecedent.

Learned APP appearing for the State opposed the anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge (POCSO), Darbhanga in connection with Sakatpur P.S. Case No. 55 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
