SINHA ORAL ORDER 08-06-2015 During pendency of this application petitioner no. 6 has been arrested, as such, his prayer for grant of bail in the event of arrest has become infructuous, which is permitted to be withdrawn as not pressed.
So far petitioner nos. 1 to 5 are concerned, they are apprehending arrest in connection with a case registered for the offences under Section 307 and other allied Sections of the Penal Code. Prosecution party of the present case has suffered injuries, which is evident from the injury report and has been taken note by the learned Sessions Judge in her order dated 06.02.2015. It is submitted on behalf of the petitioners that there
Patna High Court Cr.Misc. No.20053 of 2015 (2) dt.08-06-2015 2/2 is specific overt act alleged against petitioner no. 1 and the other petitioners are said to be his accomplice.
Let petitioner nos. 1 to 5 surrender in the court below within a period of four weeks from the date of receipt/ production of a copy of this order in the court below and apply for regular bail, which should be considered in the light of the injuries attributed to each of these petitioners as also the counter-version filed by petitioner no. 1 and the injury reports, Annexure-5 series. This petition is, accordingly, disposed of.
