JUSTICE MADHURESH PRASAD ORAL ORDER 17-10-2019 Counsel for the petitioner is permitted to implead District Provident Fund Officer, Ara, Bhojpur as respondent no.7 to the writ petition in course of the day. Heard counsel for the petitioner and counsel for the respondents-State.

Petitioner claims salary for the month of June, 2003 to 2nd July, 2003 as well as balance of provident fund amount in the instant proceedings.

Counsel for the petitioner submits that in order to facilitate payment of GPF balance to the petitioner, Principal ( respondent no.4) has repeatedly written letters to the District

Patna High Court CWJC No.5277 of 2016(2) dt.17-10-2019 2/3 Programme Officer (Establishment), Rohtas for providing details of contribution of GPF made by the petitioner. In spite of communication contained in Annexures E series and F by the State authority, till date balance amount of GPF has not been paid to the petitioner.

Counsel for the State submits that as soon as details of contribution are made available, dues and admissible amount under head of GPF shall be paid to the petitioner. Claim of the petitioner cannot be kept in limbo at the sweet will of the respondent-authorities. Inaction on the part of District Programme Officer (Establishment), Rohtas cannot be countenanced.

This court would therefore, direct that the District Provident Fund Officer, Ara, Bhojpur ( respondent no.7) should furnish all details to respondent no.4 and dues and admissible amount of GPF be paid to the petitioner expeditiously, without any undue delay and preferably within eight weeks from the date of receipt of a copy of this order before respondent no.4 and respondent no.7.

In respect of payment of salary, petitioner's counsel submits that he would be fulfilling requisite form by submitting bills etc for payment before respondent no.4 within four weeks.

Writ petition is disposed of with the aforesaid directions.
