The petitioner apprehends his arrest in connection with Jokihat P.S. Case No. 274 of 2016, registered for the offences punishable under Sections 147, 148, 149, 452, 341, 323, 307, 354(B), 380, 427, 436, 504, 506 of the Indian Penal Code and Section 27 Arms Act.

In the fardbeyan, lodged by Binod Kumar Das, against the petitioner there is no allegation for committing any overt act.

Submission is of false implication and that in this case, co-accused Anil Bishwas, Ranjeet Chaudhary, Mahesh Chaudhary, Babloo Chaudhary, Santosh Chaudhary, Pawan

Patna High Court Cr.Misc. No.7763 of 2018(2) dt.17-02-2018 2/2 Kumar Mandal and Pankaj Kumar have already been allowed pre-arrest bail vide Cr. Misc. No. 23044 of 2017 by another coordinate Bench of this Court and further Sanjay Choudhary has been allowed pre-arrest bail vide Cr. Misc. No. 31146 of 2017 by this court and the case of the petitioner stands on similar footing. The petitioner has got no criminal antecedent and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. fairly submits that other coaccused have been allowed pre-arrest bail. In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-II, Araria, in connection with Jokihat P.S. Case No. 274 of 2016, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
