JUSTICE SANJAY PRIYA ORAL ORDER 28-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kudra P.S. Case No. 97 of 2014 instituted for the offence under Section-395 of the Indian Penal Code. It has been submitted that the FIR is against unknown. The name of this petitioner has been disclosed in confessional statement of co-accused. The looted mobile is said to have been recovered from coaccused Mukesh Kumar, who has stated that he has purchased that mobile from co-accused Munna Kharwar. The co-accused Ramnagina Mushar in his confessional statement has taken the name of this petitioner.

It has been submitted that Munna Kharwar has already been granted bail by coordinate bench of this court vide order dated 09-112015 passed in Cr. Misc. No. 49452 of 2015.

Patna High Court Cr.Misc. No.32100 of 2017 (3) dt.28-07-2017 bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each in connection with Kudra P.S. Case No. 97 of 2014 to the satisfaction of learned Chief Judicial Magistrate, Kaimur at Bhabua subject to condition that both the bailors should be close relative of the petitioner.
